Terms of Service

The agreement between you and SecondBars. It covers what the service is and is not, how billing and renewal work, fair use, and how disputes are resolved.

Three things to know before you read on

1. This agreement

These Terms of Service (“Terms”) are a contract between you and Truelabel Inc (“SecondBars,” “we,” “us” or “our”). SecondBars is a service of Truelabel Inc. By placing an order, creating an account, installing a SecondBars eSIM or using the service, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not order or use SecondBars. If another Truelabel Inc service has its own terms, those terms apply to that service and these Terms apply to SecondBars.

2. Who can use SecondBars

To order and use SecondBars you must:

  • Be at least 18 years old (19 in Alabama and Nebraska; 21 in Mississippi) and able to enter a binding contract.
  • Live in the United States and give us an accurate US service address and billing details.
  • Be the owner or authorized user of the phone you install the eSIM on.
  • Give us accurate account information and keep it up to date.

SecondBars is sold for personal use. It is not sold for resale or for use by a business on behalf of others.

3. What SecondBars is, and what it is not

SecondBars is a mobile data service delivered as an eSIM. It adds a second line to a phone that can run two lines at once, so the phone has another network to use for data when your own carrier’s signal is weak or unavailable.

SecondBars is a backup, not a replacement for your carrier.

It does not replace your carrier, your plan or your phone number, and you should keep your existing service. Your calls and text messages stay on your carrier. We have no access to your carrier account and no control over it.

What is included

  • Mobile data, in the amount and coverage area of the package you bought.
  • One eSIM, for one phone.
  • Access to your SecondBars dashboard, where you can see your data usage and manage your plan.

What is not included

  • Voice calling or text messaging service. Apps that call or message over the internet may work over SecondBars data, but they are provided by their own makers, not by us.
  • A replacement phone number. Your existing number is never moved, changed or ported by us.
  • A guarantee of coverage, speed or availability in any particular place. See “Coverage, speed and network management.”
  • Any change to your phone’s settings. You choose when your phone uses SecondBars. See “Your phone and setup.”

SecondBars data is carried over licensed wireless networks operated by third parties. We do not own or operate those networks.

4. Emergency calls and 911

Do not rely on SecondBars to reach 911 or any emergency service.

SecondBars is a data service. It does not provide voice calling and is not a way to call 911. In an emergency, call 911 using your carrier’s line or another phone.

Calling and messaging apps that run over the internet are not a substitute for 911. They may not connect you to emergency services, may not send your location, and will not work if SecondBars data is unavailable, used up, slowed or switched off.

SecondBars does not make your carrier’s service more reliable, and it does not provide coverage where neither network has a signal. You are responsible for having a dependable way to reach emergency services.

5. Your phone and setup

Compatible phones

SecondBars needs an unlocked phone that supports eSIM and can keep two lines active at the same time. You are responsible for checking this before you order. Our compatibility guide explains how. A phone that is locked to another carrier, or that cannot run two lines, will not work, and that is not a reason for a refund.

Installing the eSIM

After you order we give you an eSIM to install by QR code or activation code. Service starts when the eSIM is installed and the line is active. An eSIM can be installed on one phone. If you delete it, change phones or reset your phone, contact us before reinstalling, because a deleted eSIM may need to be reissued.

Switching between lines is controlled by your phone

Whether and when your phone uses SecondBars for data is decided by your phone and its settings, not by us. Features such as automatic data switching are provided by your phone’s maker and operating system. They may behave differently between phones and software versions, may not switch at the moment you expect, and may be changed or removed by the maker.

  • You are responsible for your phone’s settings, including which line is used for data and whether data roaming is on.
  • Your phone may use SecondBars data at times you do not notice, including in the background. Data used counts against your package.
  • If your phone is set to use your carrier for data while you are abroad, your carrier may charge you roaming fees. We are not responsible for charges from your carrier.

6. Coverage, speed and network management

Wireless service depends on things outside our control: distance from a tower, terrain, buildings, weather, your phone, network congestion and the practices of the underlying network operator. We do not promise that SecondBars will have a signal where your carrier does not, or that it will be available, uninterrupted or at any particular speed.

  • United States packages work in the United States only.
  • Global packages also work abroad, in supported countries. The list of supported countries can change, and coverage inside a supported country varies. Check before you travel.
  • 5G is available only where the network and your phone support it. Elsewhere your phone uses 4G LTE or whatever the network provides.
  • Coverage maps and descriptions on our site are general guides, not guarantees.

The underlying network operator manages its network. That can include giving some traffic priority over other traffic, slowing data during congestion, and limiting speeds for certain uses. Data on SecondBars may be given lower priority than the network operator’s own customers.

7. Data packages and fair use

Your allowance

Each package includes an amount of data for each monthly billing period. Your allowance starts again when your plan renews. Unused data does not carry over to the next period and has no cash value.

When you have used your allowance, data on SecondBars is slowed or paused until your plan renews or you move to a larger package. We measure usage with the network operator’s records. The figure in your dashboard can lag behind actual use, so treat it as a guide.

Unlimited packages

“Unlimited” means we do not charge you more for using more data. It is subject to fair use. If you use more than 50 GB in a billing period, your data may be slowed for the rest of that period. Full speeds return when your plan renews.

What fair use means

SecondBars is priced as backup data for one person’s phone. The following are not fair use and are not allowed:

  • Using SecondBars as the main or only internet connection for a home, office or vehicle.
  • Using the eSIM in a router, hotspot device, tablet, camera, tracker or any device other than a phone.
  • Running servers, automated or machine-to-machine traffic, or continuous uploads or downloads.
  • Sharing your connection with others on an ongoing basis, or reselling or giving away access.
  • Any use that harms the network or other customers’ service.

Using your phone’s hotspot for your own occasional personal use is allowed. If your use is not fair use, we may slow your data, limit hotspot use, move you to a different package with notice, or suspend or end your service as described in “Suspension and termination.” Where we reasonably can, we will tell you first and give you a chance to fix it.

8. Your SecondBars line and its number

To provide service, the network operator may assign a US phone number and other technical identifiers to your SecondBars line. They exist so the line can be provisioned. The number is not provided for making or receiving calls or texts, we do not promise that it will do so, and it may be changed or reclaimed when your service ends.

Your own phone number stays with your carrier. Ordering, using or cancelling SecondBars does not transfer, port or cancel it.

9. Price, billing and automatic renewal

Price

The monthly price of each package is shown on our pricing page and again at checkout before you pay. Prices are in US dollars and do not include taxes and fees, which are added at checkout and shown before you confirm your order.

SecondBars renews automatically every month until you cancel.

  • What you are buying: a monthly subscription to the package you chose.
  • When you are charged: when you order, and then on the same day each month.
  • How much: the regular monthly price of your package shown at checkout, plus taxes and fees. If you ordered with a promotional price, that price applies for the period stated in the offer and the regular price applies after it.
  • How to cancel: in your dashboard under Account, then Plan, then Cancel plan, or by emailing support@secondbars.com. Cancel before your next renewal date to avoid the next charge.

Taxes and fees

We collect the federal, state and local taxes and government-mandated fees that apply to your service, based on your service address. These can include sales and telecommunications taxes and regulatory fees. They are itemized at checkout and can change when rates change or when you change your address or package.

Payment

You authorize us to charge your payment method for each renewal and for taxes and fees, until you cancel. If a charge fails we may try again and will tell you. If payment is not made, we may suspend or end your service after notice. Keep your payment details current.

Price changes

We may change the price of a package. If the price of your package is going up, we will tell you by email at least 30 days before the new price applies to you, and you can cancel before it does.

Changing your package

You can ask to move to a different package. Unless we tell you otherwise when you make the change, the new package and price start at your next renewal.

10. Cancellation and refunds

You can cancel at any time. There is no contract, no minimum term and no cancellation fee. When you cancel, your service continues until the end of the billing period you have already paid for, and then ends. You will not be charged again.

Charges are not refundable. We do not give refunds or credits for a billing period that has started, for data you did not use, or because the service did not work in a particular place or on a particular phone. Check coverage and compatibility before you order.

Nothing in this section limits a refund or credit that the law requires us to give. If you think you were charged in error, contact us within 60 days of the charge and we will look into it.

11. Acceptable use

You agree not to use SecondBars to:

  • Break the law, or engage in fraud, identity theft, harassment or threats.
  • Send spam, or send automated or bulk messages or calls without the consent the law requires.
  • Interfere with, probe or overload any network, system or account, or get around usage limits or security measures.
  • Infringe anyone’s intellectual property or privacy rights.
  • Resell, sublicense or share the service, or use it in a way that is not fair use as described in “Data packages and fair use.”
  • Violate US export control or sanctions laws.

12. Your account and security

You are responsible for activity on your account and for keeping your login details and your eSIM secure. Tell us right away if you think someone else has access to your account or your eSIM.

Before we reissue an eSIM or make account changes, we confirm that the request comes from you, for example by having you sign in or respond to a code sent to your registered contact details. We may refuse a request we cannot verify.

13. Other companies’ networks and services

SecondBars depends on networks, phones, operating systems, payment processors and other services run by other companies. We are not responsible for failures, delays or changes caused by them, or for charges from your carrier or any other provider, except where the law says we are.

14. Privacy and legal requests

Our Privacy Policy explains what information we collect and how we use it, including information about your use of the service. We respond to valid legal process, such as subpoenas and court orders, as described there.

15. Our content and your license

We and our licensors own the SecondBars service, software, name, logos and content. While you are a customer we give you a limited, personal, non-transferable, revocable license to use them as these Terms allow. The eSIM profile remains the property of the network operator or its supplier.

16. Disclaimer of warranties

SECONDBARS IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT SECONDBARS WILL BE AVAILABLE IN ANY LOCATION, THAT IT WILL HAVE A SIGNAL WHEN YOUR CARRIER DOES NOT, THAT YOUR PHONE WILL SWITCH TO IT, THAT IT WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR AT ANY SPEED, OR THAT IT WILL CONNECT YOU TO EMERGENCY SERVICES.

SOME STATES DO NOT ALLOW CERTAIN WARRANTIES TO BE EXCLUDED, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

17. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, TRUELABEL INC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS AND NETWORK OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS OR DATA, ARISING OUT OF OR RELATED TO THESE TERMS OR SECONDBARS, INCLUDING ANY LOSS OF SERVICE, MISSED COMMUNICATION, OR INABILITY TO CONNECT, EVEN IF TOLD THAT SUCH DAMAGES WERE POSSIBLE.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR SECONDBARS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR SECONDBARS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, FRAUD OR WILLFUL MISCONDUCT.

18. Indemnification

You agree to defend, indemnify and hold harmless Truelabel Inc and its officers, directors, employees and agents from any claim, loss, damage or expense, including reasonable attorneys’ fees, arising out of your use of SecondBars in violation of these Terms or the law.

19. Arbitration and class action waiver

Please read this section carefully. It affects your legal rights.

Talk to us first

Most problems can be fixed quickly by contacting support. Before starting an arbitration, the party with the dispute must send the other a written description of it and what they want, and allow 30 days to try to resolve it. Send yours to support@secondbars.com.

Agreement to arbitrate

You and SecondBars agree to resolve any dispute arising out of or related to these Terms or the service through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of in court. Either of us may instead bring an individual claim in small claims court if it qualifies.

YOU AND SECONDBARS EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO TAKE PART IN A CLASS ACTION, CLASS ARBITRATION OR OTHER REPRESENTATIVE PROCEEDING. The arbitrator may not combine the claims of more than one person and may award relief only to the individual party seeking it.

How to opt out

You can opt out of this arbitration agreement within 30 days of first ordering SecondBars by emailing support@secondbars.com with the subject line “Arbitration Opt-Out” and your name and account email. Opting out does not affect the rest of these Terms or your service.

If the class action waiver is found unenforceable for a particular claim, that claim proceeds in court and the rest of this section still applies.

20. Complaints to regulators

If we cannot resolve a problem, you can also contact your state attorney general or consumer protection office, your state public utilities commission, or the Federal Communications Commission at consumercomplaints.fcc.gov.

21. Suspension and termination

You may cancel at any time as described in “Cancellation and refunds.” We may suspend or end your service if you do not pay, if you break these Terms, if your use is not fair use or harms the network, if we suspect fraud, or if the law or the network operator requires it. For non-payment we will give you notice and a reasonable chance to pay first.

We may also stop offering SecondBars or a particular package. If we do, we will give you at least 30 days’ notice where we reasonably can, and we will not charge you for any period after service ends.

When service ends, your eSIM stops working and can be deleted from your phone. You remain responsible for charges incurred before service ended. Sections that by their nature should survive, including the disclaimers, limits of liability and arbitration agreement, continue to apply.

22. Changes to these Terms

We may update these Terms. If a change is material, we will tell you by email at least 30 days before it takes effect, unless the law or a security risk requires a faster change. If you do not agree, you can cancel before the change takes effect. Continuing to use SecondBars after that date means you accept the updated Terms.

23. General

  • Governing law: these Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules, and by the Federal Arbitration Act.
  • Venue: for any dispute that is not subject to arbitration or small claims court, the state and federal courts located in Nashville, Tennessee have exclusive jurisdiction.
  • Entire agreement: these Terms, the Privacy Policy and the price and package details shown at checkout are the whole agreement between you and us about SecondBars. If our site or advertising describes the service more generally, these Terms control.
  • Assignment: you may not transfer these Terms. We may transfer them as part of a merger, acquisition or sale of assets.
  • Severability: if part of these Terms is found unenforceable, the rest still applies.
  • No waiver: if we do not enforce a term, we can still enforce it later.
  • Force majeure: we are not liable for failures caused by events outside our reasonable control, including network outages, natural disasters and acts of government.
  • Lifeline: SecondBars does not participate in the federal Lifeline program.
